These Terms explain how you may use our website and online tools, how we handle appointments and payments in a cash‑based model, what messages you might receive from us, and key legal disclaimers. They don’t replace our Privacy Policy or the clinical consent documents you sign as a patient.

Scope: Website Vs. In‑clinic Care
These Terms govern your use of our website, online scheduling/forms, and any digital content we publish (the "Site"). Care delivered in person or via any approved telehealth service is additionally governed by your clinical intake, informed consent, and other service‑specific documents you review and sign as a patient. If there’s a conflict, your clinical documents generally control for clinical services.
No Medical Advice; No Provider‑patient Relationship Via Site
Content on the Site (articles, videos, exercise demos, messages) is informational only and not a substitute for an in‑person evaluation, diagnosis, or treatment plan. Using the Site does not create a provider‑patient relationship.
Emergencies: If you are experiencing a medical emergency or red‑flag symptoms, call 911 or seek emergency care immediately.
Eligibility, Accounts, And Your Responsibilities
To use the Site you must be at least 18, or have a parent/guardian use it on your behalf. You agree to:
- Provide accurate, current information;
- Use the Site lawfully and respectfully (no malware, scraping, harassment, infringement, or unauthorized access);
- Follow your provider’s instructions for home programs and promptly report changes or concerns.
Appointments, Cancellations, And Late Arrivals
- Scheduling. Schedule by phone or online (where available). Availability isn’t guaranteed; we may adjust for provider availability or emergencies.
- Cancellations/No‑shows. Please cancel or reschedule ≥24 hours in advance. Late cancellations or no‑shows may incur a fee up to the full visit price.
- Late arrivals. If you’re late, we’ll treat within the remaining time; standard fees may still apply.
- Minors & chaperones. Patients under 18 require a parent/guardian for consent; a chaperone is available on request for certain assessments/treatments.
Payment, Insurance, And Medicare (Cash‑based Model)
- Payment due at service. We are a cash‑based clinic. We accept Visa, MasterCard, Discover, Amex, cash, check, and Apple Pay. HSA/FSA cards are welcome.
- No direct insurance billing. We do not bill health insurance. On request, we can provide a detailed receipt (often called a “superbill”) for you to submit to your plan; any out‑of‑network reimbursement is strictly between you and your insurer.
- Medicare. We do not accept or bill Medicare. If you have Medicare, ask us which self‑pay services are available and how they interact with Medicare rules.
- Refunds. Services rendered are non‑refundable. Prepaid packages or gift certificates (if offered) are subject to their specific terms at purchase.
Physical Therapy Direct Access (Georgia)
When you receive physical therapy services from ESC, we comply with Georgia direct‑access law. In some situations, PT may proceed without a physician referral, subject to time/visit and condition‑based limits under Georgia law. We will advise you if/when a referral becomes necessary. (Informational only; not legal advice.)
Communications: Email, Phone, and SMS/Text (TCPA & E‑SIGN)
- Purpose. We may contact you about scheduling, reminders, follow‑ups, billing, programs, or educational content.
- SMS/Text opt‑in. If you provide your mobile number and opt in, you consent to receive SMS related to your care (e.g., reminders, follow‑ups). Message frequency varies. Message & data rates may apply. Consent is not a condition of receiving care.
- Opt‑out/Help. Reply STOP to any text to opt out. Reply HELP for assistance, or contact us via the information above. Carriers are not liable for delayed/undelivered messages. We don’t sell or share SMS consent data with third parties for their marketing.
- Email. Email is not ideal for sensitive information. Use our designated forms/portal when instructed.
- E‑SIGN consent. By using the Site, you agree to receive notices and records electronically where permitted. You can request paper copies or withdraw consent by contacting us; doing so may impact our ability to provide certain online features.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard information. Clinical records are handled according to applicable privacy laws (e.g., HIPAA). Where we use third‑party platforms for scheduling/forms, your use of those platforms is also subject to their terms and privacy policies.
Educational content & exercise demos
Any exercise library, video, or article on the Site is general education. Always follow your individualized plan. Stop any activity that causes sharp pain, new numbness/weakness, or unusual symptoms and contact us or your physician.
Intellectual Property And User Content
All Site content (text, graphics, logos, photos, videos) is owned by ESC or our licensors and protected by IP laws. You may not reproduce, distribute, or make derivative works without our written permission.
If you submit reviews, testimonials, or feedback, you grant ESC a non‑exclusive, royalty‑free license to use, reproduce, and display that content in connection with our services and marketing, subject to our Privacy Policy.
Copyright/DMCA notices: If you believe material on the Site infringes your copyright, contact us with: (a) your contact info; (b) identification of the copyrighted work; (c) identification/location of the allegedly infringing material; (d) a statement under penalty of perjury that you’re authorized to act; and (e) your signature. We’ll review and respond as appropriate.
Acceptable Use & Prohibited Conduct
You may not: (a) copy, scrape, or reverse‑engineer the Site; (b) upload malware or disrupt servers; (c) infringe others’ rights; (d) attempt unauthorized access to accounts/systems; or (e) use the Site to harass, defame, or spam.
Third‑party Links & Services
Links are for convenience only. We don’t control and aren’t responsible for third‑party sites/services or their policies. Use them at your own risk.
Accessibility & Accommodations
We aim to make our Site and clinic accessible. If you need a reasonable accommodation for a visit, communication, or to access Site content, contact us using the information above, and we’ll work to help.
No Warranties; Limitation Of Liability
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ESC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT.
Indemnification
You agree to indemnify and hold ESC and our owners, clinicians, staff, and affiliates harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site.
Governing Law & Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict‑of‑laws rules. Exclusive venue for disputes is the state or federal courts located in Forsyth County, Georgia.
Changes To These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a new Effective Date. Your continued use of the Site after changes means you accept the updated Terms.
Miscellaneous
Severability. If any provision is unenforceable, the remainder remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, merger, or transfer of assets.
Entire agreement. These Terms, plus any policies referenced (e.g., Privacy Policy) constitute the entire agreement regarding Site use.
